This volume poses, in the form of a question, a modest disjunctive proposition as regards rights, a foundation of the American regime: Has an intellectual upheaval occurred, which may be philosophically fathomed, but from which political recovery is unlikely if not impossible? Or, at long last, have we truly begun to make progress in “human rights” and begin to fulfill the promise of the American founding?
